The Main Directorate of the National Police in Kherson region reported that a russian soldier had been notified of suspicion under Article 438 of the Criminal Code of Ukraine for involvement in the torture of civilians in the village of Lyubymivka, Beryslav district, Kherson region.
Who is the suspect
Andriiauskas Denys Ivanovych (born August 22, 1989) is a native of Kostanay region, Kazakhstan, and a citizen of russia.
At the time of the crime, he served as a senior rifleman in the 5th Motorized Rifle Company of the 2nd Motorized Rifle Battalion of the 125th Regiment of the 34th Separate Motorized Rifle Brigade of the 49th Combined Arms Army of the Southern Military District of the armed forces of the russian federation (military unit 01485). Rank: private.
Circumstances of the crime
Between March and August 2022, he was deployed in the temporarily occupied territory of Beryslav district, Kherson region, where he took part in the unlawful detention of civilians at the premises of a seized pig farm “STF No. 1” (Lyubymivka).
From March 16, 2022, to April 4, 2022, one of the civilians — a security guard at an agricultural enterprise — was unlawfully held at the site.
(у вас була помилка: 2024 → має бути 2022)
Between March 29 and 30, 2022, Andriiauskas participated in the torture of this man. He first struck him at least twice in the kidney area to “overcome resistance” before interrogation. During the interrogation — aimed at obtaining information about the positions of the Armed Forces of Ukraine — he delivered at least 10 blows with his hands and feet to various parts of the victim’s body.
On April 4, Andriiauskas, together with two other servicemen, escorted the victim and other detainees to a utility room of the Biliaivka Lyceum, where they were held until August 1, 2022. They were then taken to a field on the outskirts of Mykhailivka without any documents justifying their detention or imprisonment.
In Lyubymivka, detainees were held in unsanitary conditions in an unfurnished room, using straw instead of beds, with minimal lighting. In Biliaivka, they were kept in a second-floor classroom of the lyceum from April to August 2022. They were restricted in food and water, denied access to sanitation facilities, and forced to sleep on storage racks for educational equipment.
Suspicion
The investigation classified Andriiauskas’s actions under Part 2 of Article 28 and Part 1 of Article 438 of the Criminal Code of Ukraine — violation of the laws and customs of war committed by a group of persons acting in prior conspiracy.
Criminal proceedings were registered in the Unified Register of Pre-Trial Investigations under No. 42022232090000067 dated April 6, 2022.
